Abstract
The aim of this chapter is to consider one of the most basic aspects of self-determination, dignity, and freedom: it deals with the freedom of religion from the perspective of the religious person’s status.
This issue will analyse how the legal status of religious persons is protected by both EU and international law, and how its exercise has been conditioned by the jurisprudence of the European Court of Human Rights (ECtHR) and the European Court of Justice (CJEU).
Analysis of EU law, international provisions, and CJEU and ECtHR case law demonstrates an articulated landscape that moves from the promotion and defence of religious persons’ fundamental rights, beginning with non-discrimination on the ground of belonging to a certain religion.
In this perspective, European and international institutional actors and judges have played a central role in favour of implementing anti-discrimination legislation, enforcing personal and religious beliefs and human dignity.
