본 연구의 목적은 「제주특별자치도 감귤생산 및 유통에 관한 조례」의 주요규정의 문제점을 검토하고, 그들의 개정 방향을 탐색하는 것이다. 본문에서는 「제주감귤생산유통조례」가 어떠한 배경과 내용으로 제정 및 개정되었는지를 살펴보았다. 그리고 최근에 개정된 「제주감귤생산유통조례」가 그 입법취지를 효율적으로 달성할 수 있는지를 검토한다. 이 과정에서 발견된 제주감귤생산유통조례의 문제점을 해결하기 위한 개정방향을 탐색하였다. 검토된 주요분야는 첫째, 상품용 감귤의 품질기준 설정 문제 둘째, 부재지주의 정의 및 제재방식의 문제 셋째, 일부 지원 규정의 모호성 문제 넷째, 품질검사원의 위반행위에 대한 제재정도의 문제 다섯째, 감귤유통지도원의 자격 문제 여섯째, 감귤의 품질검사 및 신고의무가 제외되는 1일 도외 반출 규모(300kg)의 적정성 문제 등이다. 이러한 제주감귤생산 및 유통에 관한 조례의 개정방향의 탐색은 최근 부각되고 있는 비상품감귤 유통행위의 효율적인 통제와 합리적인 감귤산업 지원을 통해 감귤산업의 발전에 기여할 것으로 기대된다.

This study aimed to examine the problems of the main regulations of the 「Ordinance on Citrus Production and Distribution of the Jeju Special Self-Governing Province」 and explore the direction of the ordinance revision. First, this study examined the background and content of the enactment and revision of the ordinance. Subsequently, the study reviewed whether the recently amended 「Jeju Citrus Production and Distribution Ordinance」 could effectively achieve the legislative purpose of the ordinance. In addition, an ordinance revision direction was explored to solve the problems of this amended ordinance found in the review. Meanwhile, the main issues reviewed were as follows. 1) The quality standards for citrus production for citrus use in commodities. 2) The definition of absent landowner and the method of sanctions against the absent landowner. 3) The ambiguity in some ordinance rules. 4) The sanctions for the violations of quality inspectors. 5) The required qualification to be a citrus distribution instructor. 6) The issues such as the adequacy of the scale of mandarins distributed out of the Jeju Island (300 kg per day) being excluded from the quality inspection and reporting of the distribution . In effect, it is expected that this study will support and contribute to the development of the citrus industry through efficient control of non-commodity citrus distribution, which has recently been highlighted in some studies.
