STATE BUILDING, THE CONSTITUTIONAL COLLISION OF MOLDOVA AND THE DIALOGUE "JEAN MONNET" (case study and lex ferenda)

  • 1. Universitatea Cooperatist-Comercială din Moldova, Republica Moldova

Description

The regulations of the Constitution of the Republic of Moldova contain provisions which being applied can lead to the loss of sovereignty, independence, neutrality and integrity of the Moldovan state, which in such a case is doomed to liquidation. The research of this aspect which is very important for the citizens of the Moldovan society, leads to the conclusion regarding the imperative opportunity to amend the Constitution in order to establish clear limits of revision, and to ensure the eternal existence of the Moldovan state, by ensuring the supremacy of the Constitution and by edifying the statehood of the Republic of Moldova in a clear and predictable constitutional field. As a result of the investigation, proposals are submitted regarding the need for the “Jean Monnet” dialogue, being also proposed a draft law on amending the ART.142 of the Constitution of the Republic of Moldova.
