유럽연합, 독일, 프랑스, 영국은 동일한 지침이나 법률을 공공부문과 민간부문에 대해서 모두 적용하고 있고, 개인정보를 관리․감독하는 독립된 전담기구를 두고 있다. 이들 국가들의 개인정보보호전담기구의 특징은 무엇보다도 해당 기관에 높은 독립성을 보장하고 있다는 점이다. 그 이유는 개인정보보호라는 목표의 효율적인 수행을 위해서 관리․감독기구의 인사상․조직상 독립성이 확실히 보장되어야하기 때문이다. 유럽의 개인정보 관련 법제와 인사 및 조직체계에 대한 분석을 통해서 다음과 같은 시사점을 얻을 수 있다. 첫째, 개인정보보호 전담기구의 강력하고도 명확한 권한과 책임이 보장되어야 한다. 둘째, 개인정보보호 감독기구의 권한 강화와 더불어 독립성의 강화가 중요하다는 점이다. 셋째, 개인정보보호가 잘 이루어지기 위해서는 이에 대한 정책이나 프로그램을 실행하는 담당자들에게 필요한 권한과 자원이 부여되어야 하고, 그가 정보보호에 필요한 전문성을 갖추어야 한다. 넷째, 개인정보보호 담당 조직 내의 개인정보보호에 대한 문화형성과 책임성 강화가 중요하다. 다섯째, 개인정보보호 관련 업무의 위탁관계에서 책임성 강화를 위한 노력과 대책이 필요하다. 이 밖에도 정부기관의 관련 단체나 기관에 대한 관리와 감독이 강화되어야 하고, 개인정보보호 전담기구에 제3의 기관이나 단체 등의 참여도 적극적으로 고려할 수 있다.
