이 글은 ‘인공지능 활성화 및 안전성 확보를 위한 규제완화 및 규제법 체계 개선 연구’의 3년차 과제의 내용으로 작성되었다. 이 글에서는 인공지능으로 대변되는 최첨단 과학기술의 발전이 가져오는 직업 및 국민소득의 변화를 분석한다. 그리고 사회의 변화에 대응하는 국민의 안전과 생존권 보장의 새로운 측면을 설명한 후에, 국민의 생존권을 보장하는 최신의 방법인 기본소득의 필요성과 실현 가능성에 대하여 탐색을 한다. 그리고 인공지능이 만들어 내는 새로운 산업과 경제환경 안에서 법학의 가장 중요한 이념인 공정성과 정의는 어떻게 변화하고 있는가를 검토한다. 이 글의 키워드라고 할 수 있는 기본소득에 대해서는 이미 많은 양의 연구서가 쏟아져 나오고 있다. 동 연구에 접근하는 연구자들은 사회복지 분야를 위시하여, 경제학, 사회학, 철학 등 각 분야를 배경으로 하고 있다. 법학 내에서도 헌법, 노동법, 법철학, 법사회학 등 다양한 연구 분야에서 이 주제에 접근하고 있다. 타 연구 성과와 비교할 때 이 글은 다음과 같은 의미를 가진다. 첫째로 이 글은 인공지능 사회와 그에 대한 규제의 필요성이라고 하는 대주제의 아래의 한 연구이다. 말하자면 인공지능 사회가 초래하는 사회적 문제를 해결하기 위한 규범적 대응의 한 부분을 이룬다. 둘째는 인공지능 사회가 초래하는 사회적 불안의 현상 특히 노동의 환경 변화와 직업의 소멸에 직면하여 그 충격을 완화하고 공동체를 유지하기 위한 방안을 모색한다. 셋째로 그에 대한 대응책으로 기본소득을 하나의 대안으로 제시한다. 종래의 기본소득 논의와 이 연구가 구별되는 점은 인공지능의 도입으로 증가되는 생산력을 전제로 하여 기본소득의 도입을 논의하고 있다. 다시 말하면 기본소득의 도입은 이에 필요한 재원의 확보를 전제로 하여서만 가능하며, 그 재원을 생산성의 향상에서 찾을 수 있다. 말을 바꾸면 기본소득의 도입을 위해서는 생산성을 향상시킬 수 있는 과학 기술의 발전이 전제되어야 한다. 마지막으로 이 글은 인공지능을 적용한 과학기술의 발전은 사회의 구조를 본질적으로 변화시키며, 그에 따라서 법학의 핵심 내용인 공정과 정의의 이념도 새롭게 구성되어야 한다고 주장한다. 노동사회의 공정성은 기회의 평등으로 대변된다. 보다 급진적인 입장에서는 결과의 평등을 주장하기도 하지만 사람의 능력과 자질의 불평등에 기초하는 불공평성에 대해서는 묵인하는 태도를 취한다. 기회의 평등은 법 앞의 평등을 의미하는데 즉 누구에게나 법의 적용을 같이 한다는 의미이다. 기본소득은 그 사람의 능력이나 업적에 관계없이 일정한 소득을 지불하여 기초적인 사회생활을 가능하게 한다는 취지이므로 사회에 의한 생존의 보장이라는 새로운 복지제도로서 기능한다. 그러니까 종래의 기회 평등이 형식적인 정의에 머물렀다면 기본소득은 실질적인 정의사회로 향할 수 있는 출발점이 될 수 있다는 점에서 획기적인 의미를 가진다.
This article was written as the third year of the research on the deregulation and improvement of the regulatory law system to activate artificial intelligence and secure safety. This paper analyzes the changes in occupation and national income brought about by the development of cutting-edge science and technology represented by artificial intelligence. After explaining the new aspects of people"s safety and the right to livelihoods in response to changes in society, we explore the necessity and feasibility of basic income, the latest method of guaranteeing people"s right to live. It examines how fairness and justice, the most important ideology of law, are changing in the new industrial and economic environment created by AI. There is already a great deal of research on basic income, a keyword of this article. Researchers approaching the study are based on the social welfare field, economics, sociology, and philosophy. Within legal background, this subject is approached in various fields of study, including constitutional law, labor law, legal philosophy, and sociology of law. Compared with other research results, this article has the following meaning. Firstly, this paper is a study under the large theme called AI society and the need for regulation. In other words, it forms part of the normative response to solve the social problems caused by AI era. Second, in the face of the phenomenon of social anxiety caused by AI society, especially the change of labor and the disappearance of jobs, we seek ways to mitigate the impact and maintain the community. Third, the countermeasure suggests basic income as an alternative. What distinguishes this research from conventional basic income discussions is the introduction of basic income under the premise of increased productivity due to the introduction of artificial intelligence. In other words, the introduction of basic income is possible only on the premise of securing the necessary resources, which can be found in the improvement of productivity. In other words, the introduction of basic income requires the development of science and technology to improve productivity. Finally, this article argues that the development of artificial intelligence in science and technology changes the structure of society in essence, and that the ideology of fairness and justice, the core content of law, must also be restructured. The fairness of the labor society is represented by equality of opportunity. More radical positions may argue for equality of results, but generally tolerate inequalities based on inequalities in man"s ability and qualities. Equality of opportunity means equality before the law, which means that the law applies to everyone equally. Since basic income is intended to enable basic social life by paying a certain income regardless of the person"s ability or achievements, basic income functions as a new welfare system. Thus, if the equality of opportunity remains in the formal fairness, basic income is a policy that has a significant meaning in that it can be a starting point for a really fair and just society.
