이 논문은 서비스경제의 확산과 정보통신기술의 발전에 따라 종래의 고용양식과 취업형태가 다변화되면서 노동패러다임의 재구성이 요청된다는 인식이 확산되었다는 점에 주목하여 실효성 있는 노동법제의 재구성 방안을 검토하였다. 다만 현행 노동법제는 현재까지 법이론으로서 나름의 효율성을 증명해 왔고 정보통신기술의 시대라고 해도 종전의 생산양식이 곧바로 새로운 고용양식으로 완전히 대체되는 것이 아니라 양자는 상당기간 병존하게 된다. 따라서 과도기적 상황 아래에서 새로운 법제적 대응은 가급적 신중해야 한다고 본다.
그리하여 본 연구는, 고용 범주의 확대를 통한 고용계약과 근로계약의 구분, 플랫폼산업 및 플랫폼노동을 포괄적으로 규율하는 특별법 제정, 서비스분야에 대한 허가제 노무공급사업의 법제화 등 3가지 분야에 집중하여 규율방안을 제안하였다. 이 제안의 핵심적인 뼈대는 새롭게 출현한 산업유형에서 수행되는 노동에 대해서는 그 산업을 규율하는 종합적인 특별법의 제정으로 대응하고, 기존 산업에서 새롭게 나타나는 취업형태에 대해서는 근로계약과 구별되는 고용계약의 개념 확대로 대응하자는 것이다.
