Legal Problems and Countermeasures against Domestic Violence

본 연구는 가정폭력이 개인의 사소한 문제가 아니라는 전제하에, 가정폭력의 실태를 파악하고, 가정폭력과 관련된 공공 대책으로서 경찰과 법조계, 사회적 대책으로서 상담소와 쉼터의 문제점을 살펴보고, 가정폭력의 대책과 관련된 각 부문의 역할을 고찰해 보고자 한다. 연구의 대상은 남편의 아내에 대한 구타행위이다. 사실 그 밖의 아동에 대한 학대나 노인 학대, 형제간의 폭력 등을 포괄한 가정폭력 전체도 문제시 된다. 하지만 부부간의 문제는 가족이라는 테두리만으로는 해결되지 않는 특수성을 가지므로 여기서는 부부간의 문제에 대해서만 언급한다. 또한 아내에 의한 남편 구타나 부부간 상호구타도 지적되지만 그것은 아내 구타에 비해 여전히 미미한 비율이고 그 폐쇄성이나 심각성에 있어서도 정도가 덜하며 무엇보다 그 본질적인 성격을 달리하고 있기 때문에 역시 논의에서 제외하기로 한다. 현재 구분 없이 사용되고 있는 폭력, 학대, 구타 등의 용어는 다음과 같이 정의할 수 있다. 첫째, 폭력은 신체적, 경제적, 성적, 심리적으로 상대방의 의사와는 상관없이 손상을 주는 개념으로 쓰이고 있으며 둘째, 학대는 주로 신체적, 비신체적으로 손상을 주어 지속적이고 정신적인 고통까지도 포함하는 상위 개념으로 쓰이고 있고 셋째, 구타는 주로 신체적으로 손이나 도구, 무기류를 사용하여 손상을 입히거나 위해를 가하는 것으로 쓰이고 있음을 알 수 있다. 가부장적인 한국의 사회·문화 환경 내에서는 남편이 아내에게 행사하는 아내 구타 유형의 부부폭력이 가장 빈번하며, 심각한 사회문제로 대두되고 있으므로 본 논문에 서는 가정폭력 중에서 남편이 아내에게 행사하는 신체적인 공격을 중심으로 본 연구의 범위를 구체화 시켜 다루고자 한다.

This study aims to identify the status of domestic violence, examine the problems of counseling centers and rest areas as a public measure related to domestic violence, and examine the roles of various sectors related to domestic violence, provided that domestic violence is not a minor problem for individuals. The object of the study is the beating of the husband s wife. In fact, domestic violence, which encompasses abuse of children, elderly abuse and sibling violence, is also a problem, but marital problems have a specificity that cannot be solved by the boundaries of family, so we do not mention the rest. Also pointed out is husband-and-wife mutual beatings, but they are also excluded from the discussion because it is still a small percentage of beatings, less closed or serious, and most of all, different in nature. Terms such as violence, abuse and beating, which are currently used without distinction, can be defined as follows: First, we can see that violence is used as a damaging concept, physically, economically, sexually, psychologically, independently of the other party s will; secondly, abuse is mainly used as a higher concept that involves sustained and mental pain; and thirdly, beatings are mainly used physically and physically to inflict damage or harm. In Korea s patriarchal social and cultural environment, marital violence of wife-bashing type is the most frequent and a serious social problem, so this paper tries to clarify the scope of this study with the focus on physical attacks of husband-to-wife among domestic violence.
