Digital fait currency, adapts to the economic development requirements of the digital age, is the trend of future. Compared with the private one, it has five advantages: it can stably play the function of money, facilitate macroeconomic regulation, implement monetary policy, zero credit risk, and controllable security. During the “two sessions” of China in 2018, Zhou Xiaochuan, the former president of the People’s Bank of China, first interpreted the concept of the digital fait currency-DCEP. The analysis of the history of currency issuance shows that the issuance of a new currency will have huge impact on the traditional monetary system and financial system. Similarly, the operation of the digital fait currency will inevitably impact the current monetary policy system, and the need for its supervision is unquestionable, but the supervision will unavoidable face problems such as the incompatibility of current currency issuance system and the regulatory system. At the same time, our current currency issuance system and regulatory system are not compatible with it, so we have to establish a new regulatory system. In the process of formulating the regulatory legal system, how to balance the relationship between the two values of regulation and the promotion? In the case that the regulatory object has not yet been released, how to envisage the problems that may occur ，and the supporting systems needed to consider the regulation of such setting problems? This paper first proposes to use the thinking mode of the science of law and policy. Firstly, form the theoretical framework and technical system level, the papers and patents of the Digital Currency Research Institute of the People’s Bank of China have been analyzed since 2014, this article make a preliminary description of DCEP’s distribution and circulation model. Which can be briefly summarized as “one currency, two treasuries, three centers, four modules”. Secondly, this paper also collects and sorts out institutional tools from the domestic similar industry supervision system and the existing digital currency supervision system. In order to comply with China’s policy, financial industry should serve the requirements of the real economy of the real economy, we select the appropriate institutional tools for. Finally, to establish and perfect the supervision system.

법정전자화폐는 IT 시대의 경제발전으로 인한 요구에 부합하고자 실시되었으며, 개인전자화폐에 비하여 여러 방면에서 미래 화폐 발전에 긍정적이라 할 수 있다. 2018년 중국의 ‘양회’기간 중국 중앙은행 전 은행장 주소천(周小川)은 중국이 발행하는 전자화폐 DCEP의 개념을 최초로 언급하였다. 이론구조와 기술체계 면에서 2014년 이후 중국 중앙은행의 전자화폐 연구소의 논문과 특허를 분석하여 DCEP의 발행과 유통형식에 대한 초보적 단계가 진행되었다. 이를 간략히 개괄하면, ‘1화폐, 2창구, 3 센터, 4 모듈(一币、两库、三中心、四模块)’로 구성되어 있다. 법정전자화폐의 운영은 현행 화폐정책시스템과 반드시 충돌현상이 발생하는데, 이에 대한 관리감독이 필수적이다. 하지만, 관리감독 또한 현행 화폐 발행제도와 감독시스템의 부적응 등의 문제가 반드시 발생할 것이다. 법정전자화폐의 형평적 관리감독과 촉진이라는 양면적 관계를 위하여 법정책학의 관점이 반드시 필요한데, 즉, ‘제도의 목적-제도의 수단-제도의 형식’에 있어 법정전자화폐의 감독시스템을 분석함으로써 현행 화폐제도와의 적응성과 문제점 등을 제안함으로써 장래 법정전자화폐의 발전에 기여할 수 있을 것이라 본다.

法定数字货币，适应数字时代经济发展要求，相较于私人数字货币，其具有能稳定发挥货币功能、便利宏观调控、实施货币政策以及零信用风险、安全可控等五大优势，是未来货币的发展方向。2018年中国“两会”期间，中国央行前行长周小川也首次诠释了中国拟发行的法定数字货币DCEP的概念。分析人类货币发行历史规律可知，一种新货币的发行必将对传统货币体系和金融体系造成巨大影响。同样，法定数字货币的发行对现行货币政策体系的动摇也不可避免。对其实施监管的必要性已毋庸置疑。与此同时，我们现行货币发行制度、监管体系并不与之相适应，因此不得不另行建立一套新的监管体系。 在监管法律制度的制定过程中，如何平衡监管与促进法定数字货币发展这两种价值取向之间的关系？在规制主体尚未面世的情况下，如何设想其运行可能发生的问题以及需要的配套制度，去思考此类设定型问题的规制？本文提出，借助法政策学的思维模式，以“制度目标——制度工具——制度模式”为进路解决问题。 本文首先从理论框架和技术体系层面入手，对2014年以来中国央行旗下数字货币研究所的论文和专利进行分析，初步描绘出DCEP的发行和流通模式，简要概括为“一币、两库、三中心、四模块”。其次，本文还从国内相似行业监管制度和国外已有的数字货币监管制度中搜集、梳理制度工具。结合我国金融产业须服务于实体经济的国情要求，选择合适中国的制度工具进行组合使用。最后，确立和完善出制度合理、监控有效而且有利于DCEP推广、覆盖的监管体系。
