헌법상 환경권 조항의 개정론 — 2018년 대통령 발의 헌법개정안에 대한 평가를 중심으로 —

On the Amendment of the Environmental Right Clauses of the Korean Constitutional Law

환경권 조항을 개정하자는 다양한 헌법개정안이 제안되고 있다. 환경권을 기본권이 아니라 국가목표조항으로 하는 것이 타당하다거나, 환경권을 구체적 권리로 보장하여야 한다는 주장도 제기 된다. 아울러 환경의 지속가능성, 미래세대에 대한 책임을 강조하고 생명존중 또는 동물보호를 규정하여야 한다는 주장도 있으며, 환경문제의 새로운 차원인 기후변화나 종의 다양성 보전 등 가치가 반영되어야 한다는 주장도 있다. 이 논문에서는 이들 주장에 관하여 검토하고 여러 헌법개정안과 특히 2018년 3월 대통령이 발의한 헌법개정안에 대해 살펴보고자 한다. 특히 생명 존중은 자연과 환경이 오래도록 보전되어 지속가능하도록 하는 기초가 되며 후손(미래 세대)에 대한 책임적인 태도를 형성한다는 점을 강조하 였다. 또한 그것은 건강하고 쾌적한 환경을 함께 누릴 권리를 보장하는 바탕이 된다. 동물보호 정책은 동물을 넘어 모든 생명 존중의 정신으로 확장되어야 하고, 생명존중에 충실한 태도와 환경에 대한 안목을 가지고 환경권이 해석되고 보장되도록 해야 할 것이다.

There are various proposals for the amendment of the environmental right clauses in the Korean Constitutional Law. March 26, 2018 President Moon proposed the amendment of the Constitution including the environmental right clauses. It is argued that it is appropriate to make the environmental right not as a basic right but as a national goal, or to guarantee the environmental right as a concrete right. Some also argue that ESSD(Environmentally Sound and Sustainable Development) or environmental sustainability, responsibility for the future generations and the respect for life, animal protection or species diversity should be emphasized in the Constitution. In this paper, I examined these arguments and the various proposals for the constitutional amendment. The attitude toward life in the Korean tradition should be emphasized in the argument of environmental right. The respect for life keeps nature and environment to be sustainable, and also is a responsible attitude toward the descendants (future generations). It is the basis for guaranteeing the right to enjoy a healthy and pleasant environment. The policy of animal protection should be extended to the spirit of respect for life, and the environmental right should be interpreted and guaranteed with the respect for life.
