실과(기술･가정)에서 법과 규제 교육 필요성에 관한 논의

기술의 변화와 국내외 사례를 중심으로

최근 기술 발달이 가속화될수록 정부가 법과 규제를 사용하여 기술의 혁신과 시장 형성에 관여하고, 그 영향력 또한 커지고 있다. 본 연구에서는 먼저 최신 기술 발전 사례를 바탕으로 기술 발전과 법과 규제의 인과관계를 규명한다. 이후 한국, 일본, 미국의 기술 교육 과정을 기반으로 규제 학습의 필요성을 논의하는 것을 목적으로 한다. 이론적 논의와 문헌연구를 바탕으로 사례를 분석하고, 국내외 교육과정을 비교 분석하였다. 분석결과, 신기술 발달에서 정부의 법과 규제가 핵심 요인으로 기능함을 확인하였다. 또한 한국과 일본의 교육과정에는 사회가 기술 발전에 영향을 미치는 내용이 없었고, 미국은 이를 포함하고 있었으며 법과 규제 내용도 수록되어 있었다. 기술 교육에서는 기존 교육과정에서 누락된 정부 및 사회의 역할을 포함시키고, 거시적 관점의 기술 발전 및 사회와 기술의 상호작용에 관한 균형적 시각을 기초로 내용을 구성해야 한다. 따라서 초･중학교 단계에 따른 내용 범위의 구성 방향을 달리 하여 법과 규제 내용을 수록해야 한다. 본 연구 결과는 향후 새로운 기술 발전 관련 학습 혹은 프로그램 구성의 방향을 제시할 수 있을 것이며, 이에 기초한 심화 연구 및 수업 개발이 이루어져야 함을 시사한다.

This study focuses on integrating law and regulation knowledge in technology education and the extent to which it is embedded in the curricula of the United States, Japan, and South Korea. This paper first provides description of four recent representative cases of technology innovation interacting with law and regulation. And it gives a comparative analysis of law and regulation knowledge in curricula of three countries. Results show that the government encourages and discourages specific fields of technology using law and regulation. And only the standards for technological and engineering literacy of the United States refer to functions of law and regulation in technology education out of the three curriculums. This paper discusses the extent of the content and suggests applying legal and regulatory knowledge to the regular curriculum at the primary level.
