Abstract

Era globalisasi telah menjangkit seluruh aspek kehidupan masyarakat tak terkecuali aspek ekonomi. Penggunaan alat pembayaran tunai saat ini mulai bergeser menggunakan alat pembayaran non tunai, salah satunya adalah mata uang virtual. Mata uang virtual yang tengah marak penggunaannya adalah bitcoin. Telah ditegaskan dalam siaran pers Bank Indonesia No 16/6/Dkom bahwa bitcoin bukan merupakan alat pembayaran yang sah di Indonesia, serta beberapa peraturan lain yang menyatakan bahwa bitcoin bukan informasi elektronik baru dan subyek komoditi. Namun pada kenyataannya penggunaan bitcoin  masih banyak di Indonesia karena tidak adanya regulasi yang jelas sehingga keberadaannya masih di pertanyakan. Menghadapi hal ini pemerintah diharapkan untuk dapat memberi jaminan, perlindungan, dan kepastian hukum penggunaan bitcoin melalui regulasi penggunaan mata uang virtual di Indonesia.
