이 연구의 목적은 암정보 등록에 관한 법규정을 검토하고 분석하여 암등록 사업을 위한 입법방향을 제시하는 것이다. 이를 위하여 독일과 일본의 암등록 관련 법제를 살펴본다. 우리와 독일, 일본은 암등록 사업을 실시하고 있으며, 독일은 개인정보보호를 위하여 암등록 절차 등에 관하여 별도의 법규정을 두고 있다. 반면 우리와 일본은 암관리법에 의하여 암등록 사업이 이루어지지만, 등록절차 및 개인정보보호를 위한 조치 등에 대해 별도의 법규정을 두고 있지 않다. 그리하여 암등록사업이 개인정보보호와 조화를 이루면서 성공적으로 운영되기 위해서는 등록정보와 절차 등에 관한 구체적인 법규정이 마련될 필요가 있다.
The purpose of this paper is to suggest a legislative direction by studying and analyzing the legal regulations on the cancer registration program. For this purpose, the cancer registry systems of Germany and Japan need to be reviewed. The cancer registry systems exist in Korea, Germany and Japan. Especially in Germany the law for protection of the personal data has been enacted. On the other hand, in Korea and Japan, the cancer registry system is under the Cancer Control Act, but there is no special regulation on the procedure for cancer registry and the protection for personal data. So, in order that cancer-registry program is operated successfully in harmony with the personal data protection policy, it is necessary to establish a specific legal regulation about the registry-data and the registry-proceeding.
