미술작품은 작가의 창조로 탄생한 분신처럼 생각되어 지고, 작가는 작품에 대하여 저작권을 가진다. 현대미술은 전통적인 그것과 다른 여러 가지 특징을 가지는데 그 중에서 작품의 수명, 보존과 관련된 특징으로 재료와 기법의 다양성과 불안함, 보존해야 할 작품의 원형 규정에 대한 어려움 등이 있다. 따라서 작품의 보존에 대한 작가의 의견을 묻고 그에 대한 작가의 권리를 존중하는 것은 중요한 일이다. 그러나 작품이 일단 작가의 손을 떠나 다양한 이해관계 속에 놓이게 되면 작품에 대한 작가의 권리는 일방적으로 주장할 수 있는 상황이 아닐 수 있다. 작가의 동일성유지권은 작품의 자연적 노화에 대한 변화의 수용 안에서 해석되어야 하고, 작가의 직접적인 보존처리는 지양하되 필요하다면 철저히 관리감독, 기록되어야 한다. 복제와 재제작에 있어서도 작가의 의도는 반드시 존중되어야 하고 작품의 소유자는 작가의 권리를 최대한 존중하면서 소유권을 유지해 가는 것이 바람직하다. 현대미술의 특징을 이해하고 이들의 보존 과정에서 발생하는 저작권법상의 문제들을 의미 있게 해석하고 적용하는 것은 미래의 문화자산 보존에 밑거름이 될 것이다.

Works of art are regarded as artist"s alter ego, the artist"s rights arise. Modern and contemporary art differs from the earlier art pieces in many ways, the large variety of materials and techniques used and the speed they degenerate constantly present conservators with new and complex choices. Sometimes it is difficult to define what should be preserved to keep the authenticity of the work. Artist"s intent and opinion on the conservation of contemporary art has been used as a guideline during decision making process. Also, the strong bond between the artist and the work is protected by the copyright law. However, after estrangement, it is in the legal relationship between the owner, conservator, artist and other protagonists. Artist"s copyright may not be the first consideration for the conservation of the contemporary art work. Right to the integrity must be interpreted with the understanding of natural degradation, and the restoration of works of art by artist himself has to be restricted if possible. If so, strict guidelines and documentations are necessary. Artist"s right for copying and reinstallation must be respected. Also, the ownership of works of art has to be insisted with the sincere understanding of artist"s intent. Interpreting artist"s original intent and respecting his right on the various matters on the preservation and restoration of fragile contemporary art will be valuable cultural properties in the future.
