2015년 1월 28일 공표된 “환자안전 및 의료질 향상에 관한 법률”은 많은 논의 끝에 2016년 7월 29일 시행을 앞두고 있다. 본 논문에서는 환자안전법을 통한 임상윤리의 목적도 환자의 보호측면에서 법적인 제도화이며, 이에 따른 윤리의 규범화에 대한 각국의 입법론적인 고찰을 통해 환자안전법의 시사점을 도출하는데 있다는 점에서 의의를 두고 있다. 본 논문에서는 해외 주요국가의 환자안전에 관한 최근 동향과 발전들을 살펴보고, 국내외 의료책임에 대한 판례의 동향이 의사의 의무와 책임의 범위를 확대하고 강화해 가는 경향에 비추어, 의료 기관이 환자안전제도를 통한 의료사고의 예방과 책임규율을 대응할 수 있도록 하고자 한다. 이를 위해서, 최근에 우리나라에서 제정된 환자안전법의 주요내용을 검토하고, 환자안전법 제정에 따른 임상실무에서의 법적논의 및 환자안전법의 입법취지에 따른 법제도의 정착과 예방적 시각에서 의료 분쟁요소를 사전에 예방할 수 있는 법제도적 방안을 검토하고자 한다. 아울러, 임상윤리와 책임관련 환자안전사건을 유형화하고, 주요사건보고시스템(CIRS)의 기능을 검토함으로써, 환자안전문화의 정립을 위한 의료의 질적관리에 기여하고 올바른 진료와 조직의 수준에 대한 환자안전의 적절성을 검토하고자 한다.

After in-depth discussion in Korea, Patient Safety Act, which was published January 28, 2015, will be effect on the July 29, 2016. This paper examines the legal institutionalization in the protection side of the patients on the purpose of clinical ethics through the patient safety law. What is significant point of this paper is to present implications of the patient safety law through political considerations of the another countries for the norm of ethics. This paper looks into the development and recent trends regarding to the patient safety in major foreign countries, in view of the strengthening tendency to expand the scope of duties and responsibilities in the doctor's case law on the national and international medical liability, responds to healthcare patient safety system and the prevention of medical errors through discipline and responsibility. To this end, it is recently reviewed the highlights of the patient safety law enacted in our country, and legal discussion in clinical practice due to the enactment and medical disputes factor of the legal system in accordance with the legislative intent and to review the legal and institutional measures in advance. In addition, by reviewing clinical ethics and type of responsibilities related to patient safety incidents, and the features of Critical Incident Reporting Systems(CIRS), it is helping to patients for the quality management of health care and reviewed on the level of proper care and organization for the establishment of Patient Safety Culture and the adequacy of safety.
