남녀 간의 교제 과정에서 일어나는 데이트폭력이 심각한 수준에 이르면서 정부의 실효성 있는 예방 대책이 절실하다. 그러나 가정폭력ㆍ성폭력과 달리 남녀 간의 사랑싸움으로 치부해 가해자에 대한 처벌은 솜방망이 수준에 그치기 부지기수다. 가해자에 대한 처벌과 절차를 강화하고 피해자의 신변을 보호할 수 있는 특별법을 조속히 제정할 필요가 있다. 물론 최근 여성폭력방지기본법(2018. 12 제정)이 제정되어 여성폭력방지를 위하여 국가의 책임을 규정하고 콘트롤타워 역할을 국가가 가짐을 선언하고 있으나 남성 역차별 등 위헌 소지가 있어 제정후에도 논란이 많다. 과연 여성폭력방지기본법은 데이트폭력 방지를 위하여 충분한가?라는 의문에서 출발하고자 한다.
이 글의 목적은 데이트폭력에 대하여 두 가지 쟁점 즉, 강력한 처벌에 따라 절차와 피해자 보호에 만전을 기함에 있다. 이러한 목적을 달성하기 위하여 데이트폭력의 개념과 실태를 살펴보고 데이트폭력의 쟁점을 살펴봄과 동시에 입법 방향을 제시하고자 한다.
따라서 본고에서는 데이트 폭력방지를 위한 법률적 쟁점에 따른 입법과제를 주로 논의하였다. 이를 위해 먼저 관련 법제의 기본방향을 가해자 처벌강화와 피해자 보호에 기초를 둘 것이며 데이트폭력 피해자를 보호하기 위한 제도의 보완이 필요하다.
다음으로 데이트폭력 피해자가 고통으로부터 탈피하여 그 피해를 구제할 수 있도록 법적ㆍ제도적 보완이 필요한 것이다.
마지막으로 앞으로는 데이트폭력 피해자의 보호, 지원이라는 대전제가 가해자 처벌을 위한 절차라는 큰 이념과의 만남을 통해 체계적인 연구와 실천이 이루어져, 데이트폭력으로부터 피해자들이 보호받을 수 있도록 하여야 할 것이다.
As dating abuse, which occurs between dating men and women, has become serious, the government urgently needs to get effective preventive measures. For dating abuse, which is regarded as lovers’ quarrel, the offenders usually end up being subjected to a slap on the wrist, as is not the case with domestic violence or sexual violence. It is necessary to create a special law that increases penalties for the offenders and protect the victims. Of course, Act on Preventing Violence against Women was recently created (December 2018) to specify the state responsibilities for preventing violence against women and stipulate that the state serves as a control tower, but the law remains controversial over its possible unconstitutional elements such as reverse discrimination against men. Thus, the study starts with the question: is Act on Preventing Violence against Women sufficient to prevent dating abuse?The purpose of this thesis is to ensure two things with regard to dating abuse: stiff penalty and the protection of victims. To accomplish these goals, the current study examines the concept and current status of dating abuse, survey the controversial issues related to dating abuse, and present the legislative directions. So, this thesis discusses the legislative tasks according to the legal issues related to the prevention of dating abuse. For this, we will ground the basic directions of the related legislation in the strengthening of penalties for offenders and the protection of victims, and the system needs to be upgraded to protect the victims of dating abuse. Next, legal and systematic upgrades are necessary to make sure that the victims of dating abuse can break from sufferings and recover damages. Looking ahead, the major premises of the protection of and support for the victims of dating abuse should be systematically researched and put into action through their merger with the bigger idea of the strengthening of the penalties for the offenders. Thus, it has to be ensured that the victims are protected from dating abuse.
