Abstract: Since the Third Plenary Session in 1978,China established the household contract management as the basis of the unified the two-layer management system,which expands the farmers’ land management autonomy. "Land Contract Law"(2002)has the provisions for the farmers on the land contract and management rights to take legally transfer,lease,equity,mortgage or otherwise transfer which further expands the contract management and usage rights of farmers on land. At the same time,the state also gradually improves the expropriation and procedures of land for farmers as well as the compensation and resettlement measures for farmers. The new land system in the process of change,we should further ensure farmers on the land property rights to improve the land requisition system and regulate land transfer.
