Abstract
Das Bundesverfassungsgericht hat in seiner Entscheidung vom 28. 08. 2005 zur Auflösung des 15. Deutschen Bundestages den Justizgewährungsanspruch der Antragsteller missachtet. Unter Hinweis auf die Ermessensspielräume von Bundeskanzler und Bundespräsident sowie die faktische Unüberprüfbarkeit politischer Stimmungen hat es sich aus seiner selbst übernommenen Rolle als Hüter der Verfassung zurückgezogen. An der Existenz eines ungeschriebenen materiellen Tatbestandsmerkmals des Art. 68 GG hält das Urteil nur noch formal fest. Eine genauere Analyse des Urteils verdeutlicht, dass nicht nur das Ergebnis der Entscheidung, sondern auch der gewählte Weg kritikwürdig ist.
Abstract
On 25 August 2005, the German Constitutional Court decided on the constitutionality of the dissolution of the 15th German Bundestag. In its decision, the Court rejected respective claims of the complainants with regard to the legal examination of the substantive content of the decision. It instead emphasised the discretion of the Chancellor and the Federal President when deciding upon the resolution of the Parliament as well as the fact that political sentiments cannot be subject to legal control. This way, the Court stepped back from its self-assumed role as the guardian of the Constitution. The judgment confirms the existence of substantive facts of the case, as they can be derived from Article 68 of the German Basic Law, only in formal terms. A more detailed analysis of the judgment reveals that not only the result of the decision, but also the process, by which the decision has been achieved, ought to be criticised on several grounds.
