Cyber Torts: Something Virtually New?

Abstract

This special issue of the Journal of European Tort Law focuses on the phenomenon of so-called ‘cyber torts’. After outlining potential scenarios that might fall within the ambit of this term, this paper gives an introductory overview of key problems associated with such cases from a tort law perspective. Once the potentially complex issues of identifying the proper jurisdiction and determining the applicable law are resolved, the substantive analysis in tort law can mostly be performed by applying its standard reasoning, though to novel factual settings. Practical problems in pursuing the immediate wrongdoer raise the question against which secondary defendants claims should be addressed.
