对庞德《法律史解释》的脉络简析

Abstract: 罗斯科.庞德撰写的《法律史解释》是我们认识西方法学的宝贵材料,因此对本书的理论脉络进行梳理十分必要:笔者将此书的脉络概括为一条红线,即法律必须稳定,但又不能静止不变;三条路线,即权威、哲学与历史;六种解释,即伦理和宗教解释、政治解释、人种学解释和生物学解释、经济学解释、著名法律人解释,特别指出作为社会工程的解释。
