我国民法典总则设立的必要性及基本结构

Abstract: 当前,一部完善又科学的民法典的制定已经成为我国法学人士的心声。而是否设立民法典总则及其基本结构,是我国想要制定一部体系完整且符合我国国情的民法典所要讨论的主要问题。本文通过考察大陆法系国家民法典的编纂体系,详细阐述了我国民法典设立总则的必要性,并在叙述以《德国民法典》总分模式为蓝本形成的两部亚洲民法典总则的内容结构及我国三个民法典的建议稿的基础上,引出我国民法典总则的结构。
