独立的空间权制度之构建

Abstract: 我国应确立空间权作为独立物权的地位,因为我国不仅具备了独立空间权的理论基础,而且还可以借鉴美国《空间法》的大量经验。我国现行法对空间权的保护仅仅限制在建设用地使用权中,不仅不利于空间资源利益的开发和保护,而且留下诸多法律空白,对现实中的相关纠纷束手无策。在实践中,应注意与不动产相邻关系、建设用地使用权等相关权利的区分。
