Publisher Summary

This chapter discusses the mediation rules from the United States district court for the western district of Michigan. The Mediation Clerk shall maintain a list of mediators that shall have a minimum of 50 persons at all times, and shall be updated from time to time to maintain said number. The Mediation Clerk shall select the attorneys to be included on the list of mediators in a manner directed by the Judges of the Court. Copies of the list of mediators shall be retained by, and shall be available at the office of the Mediation Clerk. When a case has been submitted for mediation, the attorney for the plaintiff, and the attorney for the defendant may each select one mediator from the list of mediators. The third mediator, who shall serve as chairman of the panel, shall be chosen by agreement of the respective attorneys. If the attorneys are not able to agree on the third mediator, said third mediator shall be selected by the agreement of the first two mediators chosen.
