Zusammenfassung
Es wird über den Fall einer 55-jährigen Patientin mit Kopfschmerzen, trockenem rechten Auge und trockener Nase rechts berichtet. In einem nach 5 Monaten angefertigten ersten Magnetresonanztomogramm (MRT) des Kopfes wurde kein pathologischer Befund diagnostiziert. Nachdem 6 Monate später zusätzlich rechtsseitige Gesichtsschmerzen aufgetreten waren, erfolgte eine zweite MRT. Es wurde lediglich eine Flüssigkeitsretention im Mastoid rechts festgestellt. Acht Monate danach kam es zu einer Abduzensparese rechts. Eine daraufhin durchgeführte Computertomographie (CT) des Felsenbeins zeigte eine ausgedehnte Destruktion im Bereich der rechten Pyramidenspitze. Die anschließend durchgeführte dritte MRT ergab einen Tumor von ca. 5 cm Durchmesser in der rechten Fossa pterygopalatina, der retrospektiv auch in dem ersten MRT mit ca. 3 cm Durchmesser und in dem zweiten MRT mit ca. 4 cm Durchmesser zu erkennen war. Die histologische Untersuchung nach Biopsie ergab ein Nasopharynxkarzinom. Es wurde eine Radiochemotheraphie durchgeführt. Die Patientin verstarb nach 9 Monaten. Die Angehörigen der Patientin wendeten sich an die Schlichtungsstelle für Arzthaftpflichtfragen. Es wurden ein neuroradiologisches Gutachten und anschließend ein HNO-ärztliches Gutachten angefordert. Die Schlichtungsstelle kam zu dem Ergebnis, dass Schadenersatzansprüche gegenüber dem Radiologen, der die 3 MRT durchgeführt hatte, begründet sind, und empfahl eine außergerichtliche Regulierung.
Abstract
This report concerns a 55-year-old female patient who presented with headache, dry right eye and dry nose on the right side. After 5 months magnetic resonance imaging (MRI) was carried out but no pathological findings were diagnosed. Right-sided facial pain appeared 6 months later and a second MRI was carried out but only fluid retention in the right mastoid was diagnosed. After a further 8 months paresis of the right abducent nerve occurred and a computed tomography (CT) scan of the petrous bone showed extensive destruction of the apex of the petrous pyramid. Subsequently a third MRI revealed a tumor of about 5 cm in diameter in the right pterygopalatine fossa which was also retrospectively visible in the first MRI with a size of approximately 3 cm and in the second MRI with 4 cm in diameter. The histological examination after biopsy resulted in the diagnosis of a nasopharyngeal carcinoma and radiochemotherapy was initiated. The patient died 9 months later. The relatives of the patient applied to the arbitration board for medical liability which requested expert opinions in neuroradiology and otorhinolaryngology. The board came to the conclusion that the claims for damages against the radiologist who had made the three MRIs were well-founded and recommended an extrajudicial settlement.
